We have now altered our terms and conditions and taken a lot of the unnecessary jargon out and simplifyed it. We have also changed the format on how they can be viewed to make it more easiler to access.
You may want to continue to reconsider your ToS.
“Double Opt-in” mail lists (Really called Confirmed Opt in. Double is marketer double talk) is the excepted method of running a mail list.

Prorate is misspelled as prorata.
Rather surprised you automatically suspend when bandwidth runs out. A simple overnight slashdotting can run up the used bandwidth and your client will be rather surprised when they wake up in the morning to find their site offline due to it with no advanced warning.
You ban IRC bots but not servers?
